Introduction

SET(P) is a UK immigration form used to apply for Indefinite Leave to Remain (ILR) under special circumstances. This application is primarily for individuals who have been granted humanitarian protection, discretionary leave, refugee status, or exceptional leave to remain in the UK. Indefinite Leave to Remain (ILR) allows individuals to settle permanently in the UK without immigration restrictions.

Who Can Apply Using SET(P)?

Individuals who have lived in the UK under the following categories may apply for ILR using the SET(P) form:

  • Refugees who have completed five years of leave under refugee status.
  • Humanitarian Protection Holders who have stayed in the UK for at least five years.
  • Discretionary Leave Holders who meet the eligibility criteria.
  • Other Exceptional Circumstances where an individual has been granted leave outside of normal immigration rules.
Eligibility Criteria

To be eligible for ILR under SET(P), applicants must:

  • Have completed the required 5-year residency period under one of the eligible categories.

Application Process
  1. Complete the Online Application: Submit the SET(P) form via the UK Home Office website.

  3. Attend a Biometrics Appointment: Applicants must visit a UK Visa and Citizenship Application Services (UKVCAS) center to provide fingerprints and a photograph.
  4. Processing Time: Decisions are usually made within six months, but priority services may be available.
  5. Receive Decision: If approved, applicants will receive their Indefinite Leave to Remain (ILR) card.
Terms & Conditions
1. Residency Requirement
  • Applicants must have continuously lived in the UK under an eligible status for the required period.
  • Any prolonged absences from the UK (over 180 days in any 12-month period) may result in application refusal.
2. Fees & Refunds
  • The £2,885 application fee is non-refundable, even if the application is refused.
  • Additional fees apply for dependents and priority processing.
  • Some applicants may qualify for a fee waiver if they are at risk of destitution.
3. Criminal Convictions & Immigration Violations
  • Applicants with serious criminal convictions may be denied ILR.
  • Any previous violations of UK immigration law (e.g., overstaying) must be disclosed.
4. English Language & Life in the UK Test
  • Applicants must pass the Life in the UK Test unless they are exempt (e.g., due to age or medical conditions).
  • The English language requirement can be met with an approved test or proof of a UK degree.
5. Dependents
  • Family members (spouse, children under 18) can apply alongside the main applicant.
  • Dependents must also meet the residency requirements.
6. Appeals & Administrative Reviews
  • If an application is refused, applicants may have the right to request an Administrative Review or Judicial Review, depending on the reason for refusal.
7. Indefinite Leave to Remain (ILR) Benefits
  • ILR holders can live and work in the UK without restrictions.
  • After 12 months on ILR, they may apply for British Citizenship.
  • ILR can be lost if the holder leaves the UK for over two years without applying for a Returning Resident Visa.
